1. General: By accessing and using this website and purchasing products or services from Element & Earth Studio, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our website or services. 

2. Products & Services:  All products are handcrafted and made to order where possible. As living plants are used, variations in colour, size, and arrangement may occur. Images are indicative only.

Workshops and experiences are subject to availability and minimum participant numbers.

3. Orders & Payments: All prices are listed in Australian Dollars (AUD).
Payment must be received in full before orders are processed or workshop bookings are confirmed. We accept payment via GoDaddy Payments, PayPal, Afterpay, Eventbrite, and other approved providers.

4. Shipping & Collection: Delivery times are estimates only and may vary depending on location and availability. Local pickup may be available by arrangement. Element and Earth Studio is not responsible for delays caused by third-party couriers.

5. Care Responsibility:  Once products are delivered or collected, ongoing care becomes the responsibility of the customer. Element & Earth Studio is not responsible for plant health following collection or delivery if care instructions are not followed. 

6. Workshop Bookings & Cancellations:  Workshop tickets are non-refundable due to advance preparation and limited availability. Tickets may be transferred to another guest with prior notice.

If Element & Earth Studio is required to cancel an event, a full refund or transfer to a future session will be offered.

7. Intellectual Property:  All content on this website, including images, text, logos, and designs, remains the property of Element & Earth Studio and may not be reproduced without permission. 

8. Limitation of Liability: To the maximum extent permitted by law, Element & Earth Studio is not liable for any indirect, incidental, or consequential loss arising from the use of our products, services, or website. Our liability is limited to the replacement or refund of the purchased product where required under Australian Consumer Law.

9. Australian Consumer Law:  Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for major failures and compensation for other reasonably foreseeable loss or damage. 

10. Privacy:  Personal information is handled in accordance with our Privacy Policy. 

11. Changes to Terms:  We reserve the right to update these Terms and Conditions at any time. Any changes will be published on this page.
